Rule 85
Impaired Instinct

(1) If a military person is injured while performing the duties of his post and during training and after treatment, it is determined by the medical ward that he is physically or mentally disabled to work in the service, such a military person shall be retired from service and he shall not exceed the age limit of retirement. The full amount of unpaid salary for seven years will be given as disability pension. After the expiration of the period of receiving the disability pension, the soldier whose service period is less than the period of pension, the same as the period of pension and the soldier whose service period is more than the period of pension, will receive the amount calculated according to the sub-rule (3) of rule 80 based on the salary received accordingly. .
(1A) Notwithstanding anything contained in sub-rule (1), in the event of military action or mobilization of the army during any accidental accident or any. If a military person is unable to work for military service due to a type of weapon injury, such a military person will be promoted to a higher position and will be retired from the service and will receive the full salary for a maximum of six years without exceeding the retirement age limit. After the period of receiving full salary has passed, the military personnel whose service period is less than the period of receiving pension. A military person with a service period equal to the period received and more than the period of pension will be entitled to pension accordingly.
(2) In addition to the pension due to disability as per sub-rule (1), the military person shall receive disability allowance at the rate of the following percentage of the amount of salary received:-
(a) 50% amount for servicemen who are disabled from 100% to 80% or have lost their mental balance,
(b) thirty-three percent of the amount to military personnel who are eighty-nine percent to fifty percent disabled or mentally unstable, and
(c) Twenty-five percent amount for military personnel who are disabled up to fifty-nine percent or who have lost mental balance. But military personnel who have received or are expected to receive disability pension may return to any service laterIf he gets a pension, he will not get disability allowance according to this rule and the amount of disability allowance that has been taken will not have to be returned.
(3) According to sub-rule (2), the determination of disability percentage will be done by the medical board according to rule 107.
(4) If a soldier dies within nine years of receiving pension and disability allowance as per this rule, only the amount of pension for the period up to nine years shall be given to a person close to the family of such soldier.
