(1) If a worker is unable to work due to an accident while working at the workplace, such worker may apply to the office for determining the percentage of disability within one year from the date of treatment or discharge from the hospital.
(2) If an application is received according to sub-rule (1), the office shall send such worker in writing to a hospital, health institution recognized by the Government of Nepal designated by the Ministry or to a medical board constituted by the Government of Nepal for determining the percentage of his disability.
(3) According to sub-rule (2), if the office receives a written request to determine the percentage of disability of a worker, the relevant hospital, health institution or medical board shall determine the percentage of disability of such worker in accordance with Schedule-6.
(4) When compensating a worker whose percentage of disability has been determined according to sub-rule (2), the relevant insurance company shall compensate the amount according to sub-section (1) of section 55 of the Act as the compensation amount due to 100% disability.
