: (1) The trade union at the establishment level that obtains the majority of the workers of the respective establishment in the election of the official trade union shall be considered as an official trade union recognized for collective bargaining with the manager on behalf of the workers.
(1A) If only one trade union is registered in an establishment, if another trade union is not registered within three months from the date of registration, the first registered trade union will be recognized as the official trade union.
(1B) When calculating the period of three months as per sub-section (1A), it will be calculated from the date of commencement of this Act.
(2) The official trade union recognized under sub-section (1) shall give written notice of the matter to the Registrar and Manager within thirty-five days from the date of such recognition.
(3) Within fifteen days from the date of receipt of the notice as per sub-section (2), the Registrar shall issue the official trade union certificate as prescribed.
(4) The procedure for the election of the official trade union shall be as prescribed.
