4.  License can be granted :

(1) If there is an application for a license according to rule 3, the ministry, after conducting the necessary investigation on the application, if it is deemed appropriate to grant the license to the applicant, take the license application according to sub-rule (2) of rule 7 and issue the license in the following format. may give:-

(a) to broadcast programs by satellite or other means of communication, to establish broadcasting centers based on digital technology and distribute signals, to receive signals from digital broadcasting centers established by other individuals or organizations and to broadcast programs or format according to schedule-2(a) to establish a broadcast center based on analog technology and broadcast the program through cable,

(a1) According to clause (a) the licensed person or organized organization produces the program by itself and broadcasts the television channel through its distribution system. In the format as per -2(a1),

(b) to broadcast the program by installing frequency modulation broadcasting system in the format as per Schedule-2(b),
(c) based on the system of distributing programs directly to the consumer through cable or satellite in the format as per schedule-2(c).

(2) Whatever is written in sub-rule (1) However, if the radio frequency cannot be provided, the license will not be granted.

4a. To change to digital system:

Persons or organized organizations that distributed signals through analog system before the commencement of this rule must change the analog system to digital system and inform the ministry within the following period by the date specified by the Ministry by publishing a notice in the Nepal Gazette: –

(a) within four years in Kathmandu Metropolitan City, Biratnagar, Birganj, Lalitpur and Pokhara and sub-metropolitan areas,
(b) within four years and six months in sub-metropolitan and municipal areas other than clause (a),
(c) within five years in other areas.
