Rule 79
gratuity
(1) A military person who has served for five years or more but has not reached the period to receive pension shall receive gratuity at the following rate if he retires or if he resigns by accepting his resignation or if he is removed from his position without being disqualified for government service in the future:-
(a) Military personnel who have served for ten years in excess of five years, the last half month pay for each year of service,
(b) the last one month's pay for every year of service of a military person who has served more than ten years for fifteen years,
(c) Military personnel who have served for more than fifteen years but have not yet reached the period to receive pension, for the last one and a half months of salary for each year of service.
(2) The calculation of gratuity to be received as per sub-rule (1) shall be done on the basis of the monthly salary received on separation from service.
(3) In case of death of a military person who has not reached the period of receiving pension but has reached the period of receiving gratuity, the gratuity that he will receive will be received by the person he wishes or, if not, by the next of kin.
(4) Regardless of what is written elsewhere in this rule, a person who is a citizen of another country with a permanent residence permit will not receive the benefits of this rule.
