According to Section 26, if a candidate nominated by a party dies before or after publication of the final list of candidates, and if a written notice is received from the election representative, related party or any other person, and if the election officer is convinced of the matter, the election officer shall immediately cancel other programs related to such election. Postponement should be reported to the commission. However, the election program will not be postponed in case of death of an independent candidate under the first-come, first-served election system or a candidate whose name is included in the closed list of candidates for proportional elections.
(2) According to sub-section (1), the election officer shall post the notice of postponement of the program in his office for the information of other candidates as well.
(3) If the information as per sub-section (1) is received, the commission shall re-determine the program related to the nomination of the candidate and the date of voting in case of the death of the candidate after the publication of the final list of candidates, including the date of voting in the event of the death of the candidate before the publication of the final list of candidates, so as not to affect the voting program of such election in accordance with this paragraph. should be sent to the election officer.
(4) Notwithstanding anything written in sub-section (3), in case the election program is postponed due to the death of the candidate, if the period for completing the work as written in the election program as per sub-section (2) of section 7 is more than fifteen days, another program shall not be published again and the same The election program should be determined in such a way that the work related to the nomination of the candidates should be completed within the time period of the program so as not to disturb the voting work.
(5) If the election program is postponed as per sub-section (1), the candidate who submitted the nomination paper before is not required to file the nomination paper again and the candidate can be nominated again only on behalf of the party whose candidate has died.
