Section 27
Death of a candidate
: (1) Before or after publication of the final list of candidates in accordance with section 24, if a candidate nominated by a party dies and a written notice is received from the election representative, the party concerned or any other person and the election officer is confident about the matter. If so, the Election Officer shall immediately suspend other programs related to such elections and inform the Commission accordingly.
(2) According to sub-section (1), the election officer shall post the notice of postponement of the election-related program in his office for the information of other candidates as well.
(3) If the information as per sub-section (1) is received, the Commission shall reschedule the program related to the nomination of the candidate and the date of voting after the publication of the final list of the candidate including the date of voting in case of the death of the candidate before the publication of the final list of the candidate, so that the voting program of such election is not affected. It should be determined and sent to the election officer.
(4) Notwithstanding anything written in sub-section (3), in case the election program is postponed due to the death of the candidate, if the period for completing the work as written in the election program as per sub-section (2) of section 6 is more than fifteen days, another program shall not be published again and The election program should be determined in such a way that the work related to the nomination of the candidates should be completed within the time period of the same program so as not to disturb the work of voting.
(5) If the election program is postponed as per sub-section (1), the candidate who submitted the nomination paper before is not required to file the nomination paper again and the candidate can be nominated again only on behalf of the party whose candidate has died.
