Section 3
Application of the Act

(1) This Act shall be applicable in relation to the determination of punishment by the court in relation to any offense and its execution. 7. Amended by Act, 2075 to amend some Nepal Acts related to the Civil Code.
(2) This Act shall not apply in the following cases:-
(a) when punishing in respect of an offense of contempt of court,
(b) when punishing in connection with proceedings relating to breach of privilege exercised by the Federal Parliament or the State Assembly,
(c) In cases where there is provision in any law that this Act shall not apply.
