Section 72
Offenses and Punishment
: (1) If any person commits any of the following acts, he shall be deemed to have committed an offense under this Act:-
(a) If the person holding the position of director of the company does not report to the court in the prescribed format regarding the financial status and transactions of the company in accordance with section 16,
(b) If anyone operates a business related to marriage without obtaining a license from the office in accordance with this Act,
(c) If the director of the company knowingly conceals the fact that the company has fallen or is about to fall,
(d) If a business related to marriage does not perform the work required to be done in accordance with this Act with good intention, or
(e) If the company's director or employee or shareholder or any person commits fraud, defraud or defraud the company or its creditors.
(2) The court may impose a fine of up to fifty thousand rupees on the director who commits an offense under clause (a) of sub-section (1).
(3) The court may impose a fine of ten thousand rupees to fifty thousand rupees on a person who commits an offense under clause (b) of sub-section (1).
(4) The director who commits an offense under clause (c) of sub-section (1) shall be fined up to two lakh rupees and such fine shall be paid personally by the director.
(5) In case any loss is caused to the company or the creditor or the related party without performing the work required to be done by the businessperson related to marriage according to clause (d) of sub-section (1) with good intention, he/she may be fined up to five lakh rupees after paying compensation for such loss.
(6) A director, employee, shareholder or any person who commits an offense under clause (e) of sub-section (1) may be punished by the court with imprisonment for a term of one to two years and a fine of one lakh to five lakh rupees.
