Rule 32

According to subsection (5) of section 13 of the Act, the person appointed as the chief executive shall enter into a performance contract with the Government of Nepal within forty-five days from the date of his appointment.
(2) In addition to other matters, the contract as per sub-rule (1) shall mention the following matters:-
(a) Details of the work to be completed by the Executive Chief and his responsibilities,
(b) the business program, plan, strategy and action plan mentioned in the proposal submitted by him and the details of its implementation and the time limit thereof,
(c) Indicators or quantities of achievements prepared so as to be able to measure the performance of the work in accordance with clauses (a) and (b),
(d) Quality of work execution.
(3) If there is a work performance agreement according to sub-rule (1), the executive head shall perform the work within the time limit specified in such contract in such a way that the indicators of performance or achievements are seen to have been achieved.
(4) The Board shall form an expert committee consisting of three members to evaluate the performance and quality of the work carried out in accordance with sub-rule (3) every year.
(5) The expert committee according to sub-rule (4) shall submit a report to the Government of Nepal after evaluating the amount and achievement of the work carried out by the executive head or its quality, whether it is in accordance with the time limit or level mentioned in the contract.
(6) Before submitting the report according to sub-rule (5), the expert committee shall interact with the executive head regarding the quantity and quality of the work performed.
(7) When evaluating the work performed by the executive head according to sub-rule (5), if it is not seen that he has performed the work within the time limit according to the performance contract or of the quantity and quality according to such contract, it will be considered that he has not performed the work according to the performance contract.
(8) Notwithstanding anything contained in sub-rule (7), the work to be carried out by the executive head within the prescribed time limit and the prescribed quantity andIf it is not possible to edit the quality, the executive head should provide the details of the same to the expert committee before submitting the report according to sub-rule (5).
(9) If the details submitted according to sub-rule (8) are reasonable, the performance of the executive head will be evaluated on the basis of the achievement, quantity and quality of the performance of the work performed within the period during which the performance has not been performed due to circumstances beyond the control.
(2) In addition to other matters, the contract as per sub-rule (1) shall mention the following matters:-

(b) the business program, plan, strategy and action plan mentioned in the proposal submitted by him and the details of its implementation and the time limit thereof,
(c) Indicators or quantities of achievements prepared so as to be able to measure the performance of the work in accordance with clauses (a) and (b),
(d) Quality of work execution.

(6) Before submitting the report according to sub-rule (5), the expert committee shall interact with the executive head regarding the quantity and quality of the work performed.
(7) When evaluating the work performed by the executive head according to sub-rule (5), if it is not seen that he has performed the work within the time limit according to the performance contract or of the quantity and quality according to such contract, it will be considered that he has not performed the work according to the performance contract.
(8) Notwithstanding anything contained in sub-rule (7), the work to be carried out by the executive head within the prescribed time limit and the prescribed quantity andIf it is not possible to edit the quality, the executive head should provide the details of the same to the expert committee before submitting the report according to sub-rule (5).
(9) If the details submitted according to sub-rule (8) are reasonable, the performance of the executive head will be evaluated on the basis of the achievement, quantity and quality of the performance of the work performed within the period during which the performance has not been performed due to circumstances beyond the control.
