(1) There will be one executive director to act as the administrative head of the committee (2) The Government of Nepal shall appoint the Executive Director on the recommendation of the recommendation committee under sub-section (3).
(3) To recommend the appointment of the Executive Director, there will be a recommendation committee as follows:-
(a) Member of the National Planning Commission (looking after concerned area) – Coordinator
(b) Secretary, Ministry of Industries – Member
(c) One member appointed by the committee from among experts who have worked in the field of industry, commerce, trade, revenue administration, law, engineering or management. (4) The recommendation committee as per sub-section (3) shall select for the post of executive director from among the persons having at least ten years of experience in the field of industry, commerce, trade, revenue administration, engineering or management from a recognized educational institution with at least a master's degree in management, economics, engineering or law. The names of three people to be appointed will be recommended to the Government of Nepal.
(5) The term of office of the Executive Director shall be four years and if his work is found to be satisfactory, the Government of Nepal may appoint him to the post of Executive Director for one more time on the recommendation of the recommendation committee as per sub-section (3).
(6) Notwithstanding anything written in sub-section (5), if the executive director does not fulfill his official responsibilities or takes any action contrary to the interest of the committee, if it is found that he has not fulfilled his official responsibility or has taken any action contrary to the interest of the committee during the necessary investigation by the Government of Nepal. He can be removed from the position of executive director at any time. However, he will not be deprived of the opportunity to present his explanation before being removed from the post of executive director.
(7) The arrangements regarding the executive director's remuneration, service conditions and facilities shall be as prescribed.
(8) Notwithstanding anything else written in this section, until the appointment of the executive director as per sub-section (2), the ministry shall appoint a gazetted first class officer of the Government of Nepal to act as the executive director for a maximum period of six months.
