If someone commits any of the following acts, he shall be punished as described below:-

(a) The Nepal Government shall publish a notice in the Nepal Gazette for the price fixed by the Government of Nepal and for the price not fixed by the Government of Nepal. If someone sells a product at a price higher than the price determined by the manufacturer, importer or main distributor of the product, the price of the product will be returned and the product will be confiscated and he will be imprisoned for one year and may be fined up to ten lakh rupees. Explanation: When determining the wholesale or retail price of a product, the price should be determined in such a way that the consumer can get it at a reasonable price, after understanding the opinions of the relevant sector.

(B) Freight charges,

(C) Customs duties,

(D) Taxes of any kind recognized by the prevailing laws, levied when importing or producing goods. (e) establishment expenses, (f) reasonable commissions of dealers, retailers or agents, and (g) Reasonable profit of the producer or importer.

(b) If any goods as per Clause (a) which are not readily available in the open market at the specified price, are for private consumption, such goods or order coupons are taken with or without an order or coupon. If he is sold with or without commission, or given in any other way, he may be imprisoned for up to one year or fined up to two hundred and fifty thousand rupees or both by returning the commission taken against the order coupon and confiscating the order coupon. But -

(1) If it is not necessary after the goods have been taken, the written approval of the person whose order coupon has taken the goods should be given to the person designated by him without increasing the price. If the goods are not received, the order coupon must be returned immediately.

(2) For the private consumption of such goods without being overcharged.(c) If someone sells a ticket for an entertainment or transportation service at a price higher than the price of the ticket, the excess price will be confiscated. may be imprisoned for up to 1 year or fined or both.

(d) The Government of Nepal shall constitute price determination advisory committees as necessary for the purpose of determining the price under this section.
