: (1) If the owner of the property in the use or possession of the company or in the possession of the company or has leased such property from the restructuring program approved by the court after being passed by the meeting of creditors in accordance with this paragraph, except in the following cases There will be no hindrance to exercise or return the rights of such property:-
(a) if the owner or lessor of such property votes in favor of such program or otherwise gives written consent that such program is acceptable to him,
(b) If the court orders that the program shall be binding on the owner or lessor of such property.
(2) If the court is satisfied with the following matters, it may make an order as per clause (b) of sub-section (1):-
(a) If the owner or the lessor of such property withdraws the said property, the achievement of the restructuring program will be fundamentally adversely affected,
(b) If the interest of the property and the owner or lessor of such property is adequately protected under such restructuring program.
