Section 40
Calculation of period of imprisonment
: (1) In calculating the period of imprisonment, it shall be calculated from the date when the offender is in custody or in prison and from the date of his stay in prison if he is not in custody.
(2) The days of release from custody or imprisonment during the period as per sub-section (1) shall not be counted in the period of imprisonment.
