(1) If an offender whose imprisonment is fixed for less than one year commits an offense for the first time and considering the offense committed by him, his age, conduct, the circumstances of the offense, the method adopted while committing the offense, the court may suspend the imprisonment of such offender without immediate execution. can
(2) According to sub-section (1) "When suspending the imprisonment sentence, it can be suspended for three years from the date of determination of the imprisonment sentence.
(3) Notwithstanding anything contained in sub-section (1), the imprisonment of an offender other than a child convicted of the following offenses shall not be suspended:-
(a) Killing or maiming or causing bodily harm by using acid or other inflammable substance. (b) Coercion,
(c) Human Trafficking and Trafficking,
(d) Arms, ammunition and explosives,
(e) Amended by Act, 2075 to amend some Nepal Acts related to corruption, 7 Civil Code. Added by Act, 2079 to amend certain laws related to corn criminal offenses and criminal procedure.
(f) Taking body hostage or kidnapping,
(g) Dr (h) Falsified Tak ba Khota Ticket Challan,
(i) Foreign Exchange,
(h) Offenses related to drug trafficking and dealing (k) relating to ancient monuments,
(l) relating to forest and wildlife,
(d) organized crime,
(d) asset laundering,
(n) an offense involving torture or cruel, cruel, inhuman or degrading treatment; (i) Crimes against humanity.
(4) When ordering the suspension of imprisonment under sub-section (1), the offender shall order the following conditions throughout the period of suspension:-
(a) doing any public work free of charge, 7(b) assisting the victim in any work if the victim consents,
(c) not to do any act or conduct specified in such order,
(d) Not to go anywhere other than his residence or a particular place,
(f) To amend certain Nepal Acts relating to the 8 Customs Code, to be within the limits of any place specified by the CourtAmended by Act, 2075 7 Amended by Act, 2075 to amend some Nepal Acts related to the Civil Code. 10. Removed by Act, 2075 to amend some Nepal Acts related to the Civil Code (g) stay in a treatment and rehabilitation center,
(h) Not meeting any particular person.
(5) Regardless of what is written in sub-section (4), while suspending the punishment in the case of children as per sub-section (1), considering the child's age and the circumstances of the offence, it may be decided as follows:-
(a) To be reminded and explained about good human behavior by a family member or guardian,
(b) Enforce referral of children by organizations or individuals providing services,
(c) Providing individual, group or family psychosocial counseling services,
(d) To keep under the guardianship of a family member, custodian, school, service provider or organization for a certain period of time by following the prescribed conditions.
(6) If the offender complies with the things mentioned in the order as per sub-section (4) throughout the period of suspension, he shall be deemed to have paid the imprisonment determined as per sub-section (1).
(7) If the offender violates the order under sub-section (4), the court shall cancel the order under sub-section (1).
(8) After the cancellation of the order in accordance with sub-section (7), such offender shall pay the entire imprisonment in prison.
