(1) If an offender whose imprisonment is fixed for less than one year commits an offense for the first time and considering the offense committed by him, his age, conduct, the circumstances of the offence, the method adopted while committing the offence, the court may suspend the imprisonment of such offender without immediate execution. (2) According to sub-section (1) "suspension of imprisonment sentence" may be suspended for three years from the date of determination of imprisonment sentence.
(3) Notwithstanding anything contained in sub-section (1), no “suspension of imprisonment” shall be granted to an offender other than a child convicted of the following offences:-
(a) Duty of life,
(b) Coercion,
(c) Human Trafficking and Trafficking,
(d) Arms, ammunition and explosives,
(e) Corruption,
(f) taking body wraps or kidnapping,
(g) Dr (h) false talk or false ticket circulation,
(i) Foreign Exchange,
(j) Offenses related to drug trafficking and dealing (k) relating to ancient monuments,
(l) relating to forests and wildlife,
(d) organized crime,
(d) Asset Laundering,
(n) an offense involving torture or cruel, cruel, inhuman or degrading treatment,
(i) Crimes against humanity.
(4) When ordering the suspension of imprisonment in accordance with sub-section (1), the offender shall order the following "conditions" throughout the period of suspension -
(a) performing any public work free of charge, "(b) assisting the victim in any work with the consent of the victim, "(c) not doing any work or behavior mentioned in such order,
(d) Not to go anywhere other than his residence or a particular place,
(f) remain in any place specified by the court,
(g) stay in a treatment and rehabilitation center,
(h) Not to meet any particular person.
(5) Regardless of what is written in sub-section (4), while suspending the punishment in the case of children according to sub-section (1), considering the child's age and the circumstances of the offense, the decision can be made as follows:-
(a) Any family member or guardianTo remind and explain about good human behavior by
(b) To require orientation of children by organizations or individuals providing services,
(c) Providing individual, group or family psychosocial counseling services,
(d) To place under the guardianship of a family member, guardian, school, service provider or organization for a certain period of time by following the prescribed conditions.
(6) If the offender complies with the things mentioned in the order under sub-section (4) throughout the period of suspension, he shall be deemed to have paid the imprisonment determined under sub-section (1).
(7) If the offender violates the order under sub-section (4), the court shall cancel the order under sub-section (1).
(8) After the cancellation of the order in accordance with sub-section (7), such offender shall pay the entire imprisonment in prison.
