Section 33
Fund
(1) The Commission shall have a separate fund and such fund shall contain the following amounts:-
(a) Amount received from Government of Nepal,
(b) money received from any person or association,
(c) Funds received from foreign governments, individuals or international organizations,
(d) the amount received as determined by the Commission without increasing to one percent of the annual total income from the sale of electricity of the person who has received the electricity distribution license,
(e) The amount received as prescribed by the commission, not exceeding one percent of the annual gross income of the person who has received a license to trade in electricity,
(f) the amount received as specified by the commission without increasing to one percent of the wheeling fee received by the person who has received the permit to extract electricity using the national grid,
(g) Service fee received in accordance with section 20,
(h) Amount received from other sources.
(2) Before receiving the amount as per clause (c) of sub-section (1), the Commission shall obtain the approval of the Ministry of Finance.
(3) The Commission shall open an account and deposit the amount of the fund as per sub-section (1) in any 'A' category commercial bank licensed by Nepal Rastra Bank.
(4) All expenses incurred in the name of the Commission shall be met from the amount accumulated in the fund as per sub-section (1).
(5) If the amount in the fund is not enough for the operation of the commission, the Ministry of Finance will make the necessary amount available.
(6) If more than the specified amount is accumulated in the fund, the Commission shall deposit such excess amount in the accumulated fund of the Government of Nepal.
(7) The operation of the account of the fund under sub-section (1) shall be as prescribed by the Commission.
