: (1) If there is damage to government, public or private property by committing any offense under this Act, compensation shall be paid from the person who committed or caused the offense.
(2) For the purposes of sub-section (1), while disposing of the case, the court shall also determine the amount of compensation to be paid as per sub-section (1).
(3) While determining the compensation according to sub-section (2), the actual loss or damage to the property shall be considered as the basis.
(4) The compensation determined according to sub-section (2) shall be paid by the offender and if not, the property belonging to his share shall be auctioned and collected.
(5) If the recovery cannot be done according to sub-section (4), the penalty shall be imprisonment for the period prescribed by the prevailing law.
