Rule 8
Authority of Food Inspector

(1) The food inspector may exercise the following powers in the course of performing his duties:-
(a) may take samples of food from places where food is produced or stored or sold and distributed,
(b) If he feels that there is a possibility of spread of communicable diseases through the sale and distribution of any foodstuff, and if in his opinion the local health officer also agrees, he can prohibit the sale and distribution of such foodstuff with the approval of the local district officer,
(c) If there is reasonable suspicion that any food item is contaminated or of low quality, he may prohibit the sale and distribution of such food item with the approval of the local district officer. (d) In case of inspection of any foodstuff, any container or packet or bag or any such item is to be entered into the real estate where the food is kept, the permission of the owner of the real estate or any person in charge of the place. If permission is obtained, and if such person does not give permission, the representative of the concerned village development committee or municipality or the nearest police office can enter in accordance with the prevailing law.
(e) In relation to the person who produces the food or any other edible or non-edible substance found in the place where the food is produced, if the producer is unable to state a satisfactory use, if he sees or suspects the possibility that the substance may be mixed with the food being produced while there. Can order the immediate removal of such substance from there,
(f) To stop and inspect any foodstuff being exported or imported or transported, if deemed necessary, and if there is any reasonable suspicion that such foodstuff is contaminated or of low quality, in accordance with this regulation,
(g) The sample taken for food analysis in accordance with this regulation may be sent for analysis by any government or non-government means of transport or post,
(2) The food inspector shall immediately send the notice of action taken according to clause (b), (c) and (f) of sub-rule (1) to the director general, head of regional food technology and quality control office and local district officer.
