Dead, missing or unable to be a witness according to this Act or unable to be taxed or proved by the party of the case that it is not possible to appear in the court due to the presence of the opponent's trap or in a situation where the court cannot issue a subpoena or in the opinion of the court The following statements made by a person deemed inappropriate to be present because of unnecessary expense or time may be taken into evidence:
(a) Anything expressed in a way that is contrary to his rights, interest or self-interest,
(b) any matter expressed in writing which may give rise to any legal action or criminal prosecution against him,
(c) any matter expressed in writing before the suit is made in relation to any public right or custom of which he is specially aware, or
(d) anything expressed by him before the suit relating to matters of relationship specially known to him.
