(1) The judge of the concerned district court may order that a prisoner who has served two-thirds of the prison term and has good conduct be placed in an open prison on the recommendation of the prison chief. Explanation For the purposes of this section, "open prison" means any place designated by the Government of Nepal so that the prisoner can do any work even outside the place where he is kept at the specified time.
(2) When he is sent to an open prison according to sub-section (1), he shall specify the conditions to be followed.
(Rock) An offender kept in an open prison under sub-section (1) sub-section
(2) If he complies with the conditions and pays such period, he shall be deemed to have served such imprisonment while in open prison.
(3) If a prisoner sent to an open prison as per sub-section (1) does not comply with the conditions as per sub-section (2) or if he commits any offense punishable by imprisonment during such period, he shall serve the remaining imprisonment sentence assigned to him while in prison.
