Rule 89
<br> to arrange the purchase of gas
The public body that has to arrange rations may arrange for the purchase of rations by calling for sealed bids or bids in accordance with the Act and this regulation, so that new suppliers must supply rations from January 1st of every year.
(2) When calling for sealed bids or bids to be called according to sub-rule (1), the public body shall also mention the following:-
(a) Ration, Sida, grain, type, quality of food, (b) quantity required daily,
(c) no increase in price throughout the contract period, and
(d) Contracts can only be made with Nepali citizens.
(3) When arranging the rations of the security agencies, the following should be done:-
(a) The sale of the sealed bid form or documents related to the bid can be done through the relevant security agency, district administration office and the office of the Controller of Finance and Accounts, and the fact that such sealed bid or bid can be submitted to the relevant security agency should be mentioned in the notice of the sealed bid or bid request. The time and place of opening of the sealed bid or bid should also be mentioned in the sealed bid form or the documents related to the bid. (b) The security agency that has to arrange ration shall send at least twenty copies of the sealed bid form or documents related to bids for sale to the agency as per clause (a) and if not enough, such form or as per the request of such agency The document should be sent by the relevant security agency.
(c) Forms or documents received in accordance with clause (b) shall be sold by the agency as per clause (a) to the interested bidder or bidder and the record shall be sent to the relevant security agency.
(d) Sealed Bidders or Bidders making purchases under Clause (c) shall duly fill in such forms or documents and submit such bids or bids to the security agency that arranges ration by himself or through his representative or by post or courier.It can be sent or delivered within the period specified in the notification of Ashwan.
(e) The sealed bids or tenders received according to clause (d) shall be received by the Security Agency and kept a record thereof.
(f) The concerned security agency shall open the sealed bids or bids received in its office immediately after the last date and time for submission of such sealed bids or bids at the time mentioned in the sealed bids form or the documents related to bids. Explanation: For the purpose of this sub-section, "security agency" means the Nepal Army, Nepal Police and Armed Police Force or any body designated by the Government of Nepal. (4) The relevant public body shall prepare a comparative table of sealed bids or bids opened in accordance with this rule in the format as per Schedule-7. Sap. (5) The public body shall accept the sealed price list or bid of the lowest bidder in accordance with the Examination and Evaluation of Bids or Bids Act and this regulation as per sub-rule (4) and shall enter into an agreement with the lowest bidder.
(6) If it is found that the price of two or more items of goods submitted by a sealed price list or a tender in accordance with this rule is more than 100 percent of the prevailing market value, the evaluation committee may recommend the cancellation of such sealed price list or bid. > (7) According to this rule, within seven days of the purchase agreement, the head of the public body shall prepare a report with a comparative table as per sub-rule (4) and inform the taluk office and the public procurement monitoring office.
(8) In order to arrange ration according to the purchase agreement, if there is a shortage of grain in the local market when the supplier buys grain according to the purchase agreement, the relevant chief district officer should contact the food related agencies and provide the necessary license to arrange ration by purchasing grain from other districts. (9) If due to any kind of delay, the settlement of ration cannot be done or if the government suffers losses, thenThe head of the relevant public agency will be responsible for the loss.
(10) In the case of the matter mentioned in this paragraph, the public body that arranges the ration shall arrange the ration according to this and in the case of other matters in accordance with the provisions of the Act and this regulation.
