Unless the subject or the context requires otherwise, in these regulations,- (a) "Act" means the Public Procurement Act, 2063.
(b) "Multi-year contract" means a contract with a duration of more than one year.
(c) "Sealed quotation" shall mean the details submitted by a person, firm, company or organization interested in carrying out any construction work or providing goods or other services in accordance with the notification of the public body, including the price in a sealed envelope.
(d) "Secretary" means the Secretary of the Ministry and the term also refers to the Chief Secretary of the Government of Nepal and any other official of the Government of Nepal who performs functions similar to the Secretary.
(e) "Taluk Office" means an office higher than the concerned office.
(f) "Office of the Controller of Funds and Accounts" means the Office of the Controller of Funds and Accounts under the Office of the Comptroller General.
(g) "Rate Determination Committee" means the Committee under Rule 148.
(h) "Head of Department" means an officer working as the head of a department or other similar office under a ministry.
(i) "Ministry" means the Ministry of the Government of Nepal and the term also refers to the office of the Prime Minister and the Council of Ministers.
(h) "Standing List" means the list as per Rule 18.
(k) "Consumer Committee" means a committee formed by the persons who will directly benefit from the construction work for the construction, operation and maintenance of any construction work.
(l) "Management Agreement" shall mean an agreement as per Clause (f) of Schedule-4. (d) "Evaluation Committee" means the Committee under Rule 147.
(d) "Bid price" means the amount determined by the test of a bid.
(n) "Sub-Contractor" means a contractor, supplier, consultant or service provider who enters into any purchase agreement under a separate agreement.It should be considered a construction business, supplier, consultant or service provider who performs any work under the purchase agreement.
(p) Proprietary goods" means accessories and spare parts made by the manufacturer of any goods, device or equipment for the operation or maintenance of such goods, device or equipment.
(h) "Contract Price" shall mean the purchase price mentioned in the purchase agreement and by that term, if a variation order is issued under such contract, the price maintained during the measurement of the work carried out in accordance with such order and if the price is adjusted, the purchase price maintained as a result of such adjustment It refers to the same.
(D) "Structural or Unit Rate Agreement" means an agreement as per Clause (b) of Schedule-3.
(d) "Deposit" means any construction work done by the public body itself.
(N) "Review Committee" means the committee constituted under sub-section (1) of section 48 of the Act.
(p) "Medicinal goods" means medicines, vaccines or vaccines, syringes, blood bags, laboratory chemicals (2 agents), family planning hormonal products or health-related devices used for diagnosis and treatment of diseases.
(f) "Electronic Tender" means the tender submitted by the bidder using electronic procurement system.
(b) "Electronic procurement system" means the procurement system established, operated and managed by the Public Procurement Monitoring Office using electronic communication media in accordance with Rule 146.
(b) "Electronic communication medium" means the electronic communication technology, method or medium used by the Public Procurement Monitoring Office to establish, operate and manage the electronic procurement system.
(m) "Government fund" shall mean the federal reserve fund, state reserve fund or local reserve fund and the term also refers to other government funds established in accordance with prevailing laws.
