Section 14
Maintaining Confidentiality
: (1) While providing health services, information about the health condition of the service recipient, diagnosis or treatment received by him shall be kept confidential.
(2) Notwithstanding anything contained in sub-section (1), this section shall not be deemed to prevent the publication of information in the following cases:-
(a) If the subscriber gives written consent to the disclosure of the information,
(b) If the notice is to be made public according to the order of the court or the prevailing law,
(c) If the public health is seriously affected by non-disclosure of the information.
(3) For the purpose of clause (c) of sub-section (2), whether or not there is serious impact on public health shall be as decided by the designated authority.
(2) Notwithstanding anything contained in sub-section (1), this section shall not be deemed to prevent the publication of information in the following cases:-
(a) If the subscriber gives written consent to the disclosure of the information,
(b) If the notice is to be made public according to the order of the court or the prevailing law,
(c) If the public health is seriously affected by non-disclosure of the information.
(3) For the purpose of clause (c) of sub-section (2), whether or not there is serious impact on public health shall be as decided by the designated authority.
