Rule 94
Provisions relating to tenancy of real estate

(1) In the case of public bodies renting real estate, in the case of central level public bodies within the Kathmandu Valley, a notice of at least fifteen days should be published in a national newspaper, and in the case of regional or district level public bodies, a notice of at least seven days should be posted on the notice board of such body and the following office. It will be:-
(a) District Administration Office, (b) District Development Committee, and (c) Treasury and Accounts Controller's Office. (2) In the notice as per sub-rule (1), the public body shall disclose the following:- (a) Name and address of the concerned public body, (b) Area or location where real estate is required, (c) Nature, area and area of ​​real estate sought to be rented. Other necessary details, (d) Real estate will be rented only at the rate determined by the committee as per sub-rule (4),
(e) the manner in which the landlord may submit a proposal and the minimum particulars to be submitted with such proposal,
(f) Place and last date for filing proposals,
(g) the terms of payment of rent of real estate and the subject of tax deduction, and
(h) Other matters deemed appropriate by the public body.
(3) The public body shall open the proposal to lease the real estate filed within the period as per sub-rule (1) and submit it to the committee as per sub-rule (4).
(4) In order to determine the rent of the real estate to be rented by the public bodies, there will be a house rent determination committee as follows in each district:-
(a) Chief District Officer, -Chairman (b) Head, Treasury and Controller of Accounts Office, -Member (c) Technician appointed by the District Coordination Committee, -Member (d) Head of the public agency that leases real estate -Member
(e) Employees of the District Administration Office appointed by the Chief District Officer (officer level if available) - Member-Secretary
(5) The procedure for the meeting of the committee as per sub-rule (4) shall be as determined by the committee itself.
(6) The committee under sub-rule (4) shall evaluate the proposals submitted under sub-rule (3).The rent of real estate will be determined on the basis of:-
(a) The location of real estate and road facilities, (b) Structure and area of ​​real estate. (c) Physical facilities,
(d) Premises of real estate,
(e) the rent amount offered by the landlord, and (f) the prevailing rate of rent.
(7) After determining the real estate rent amount according to sub-rule (6), the real estate rent determination committee shall give the information in writing to the relevant public body.
(8) After receiving the information as per sub-rule (7), the relevant public body shall enter into an agreement with the relevant real estate owner and lease the real estate.
(9) The agreement under sub-rule (8) can be renewed with the consent of the landlord and the public body.
(10) If there is an increase in the rent of real estate, the approval of the Ministry of Finance must be submitted to the committee under sub-rule (4) for determining the rent of real estate. (11) If the public body needs to rent the house at an annual rent of up to fifteen lakh rupees within the Kathmandu valley and up to five lakh rupees outside the Kathmandu valley, it shall negotiate with the owner of the house in relation to services, facilities and rental amount in the appropriate proposal from among the proposals received in accordance with the notification under sub-rule (1).
