(1) No one shall construct a movie house without obtaining a license from the provincial government or an official designated by the provincial government. When building a movie house, the approval of the map must be obtained from the concerned rural municipality or municipality.

(2) According to sub-section (1) Form of application to be given for obtaining a license for building a movie house, format of the license and compliance by the licensee. The conditions to be done and the fee to be paid will be as specified.
(3) After receiving the application as per sub-section (2), the provincial government may issue a license to the applicant, especially taking into account the following points:-
(a) Obstacle or inconvenience to any educational institution, hostel, hospital, place of public importance, organization or government office while allowing construction of movie house as per the application,
(b) the need for such cinema houses on the basis of population,
(c) submitted a map of the movie house with adequate arrangements as specified for the safety, health and convenience of the audience,
(d) Whether or not such license can be granted according to other Nepalese laws.
