Rule 36
Issuance of separate identity card

(1) According to Section 47 of the Act, to the person who has obtained a certificate of non-resident Nepali citizenship or other foreigner residing in Nepal for a continuous period of one hundred and eighty days or more, the Government of Nepal shall publish a notice in the Nepal Gazette and issue a separate identity card of a temporary nature from the specified date will end
(2) In accordance with sub-rule (1), when such identity card is issued to another foreigner who is entitled to reside in Nepal, it shall be issued for the entire period of his/her right to reside in Nepal.
(3) For the purpose of issuing identity card according to sub-rule (1), the immigration department shall provide the department with the details of the foreigner residing in Nepal for one hundred and eighty days or more.
(4) A non-resident Nepalese citizen who wishes to obtain a separate identity card as per sub-rule (1) shall submit a report to the department in accordance with Schedule-33 and other foreigners shall submit a report to the department in accordance with Schedule-34.
(5) If an application is received according to sub-rule (4), the Director General may issue an identity card in accordance with Schedule-35 in the case of a non-resident Nepalese citizen and in the case of other foreigners in accordance with Schedule-36 after conducting the necessary investigation in that regard.
(6) If the period of residence of other foreigners in Nepal is extended and the identity card according to sub-rule (5) needs to be renewed, the concerned person should submit an application to the department in the format as per schedule-37.
(7) If an application is received as per sub-rule (6), the department shall take the fee as per schedule-3 and renew the identity card for the duration of the extension.
(8) After the publication of the notification according to sub-rule (1), non-resident "Nepali citizenship persons and other foreigners shall submit the identity card as per sub-rule (1) in order to receive the service facility according to the prevailing Nepal law.
(9) The identity card issued in accordance with this rule shall be canceled in the following cases:-
(a) If such citizenship of a non-resident Nepali citizen is revoked,
(b) In the case of other foreigners, if the period for residence in Nepal expires, or if the residence permit in Nepal is revoked. (10) The details of the identity card issued in accordance with this rule shall be kept up to date in the National Identity Management Information System.
