Rule 12
Control of fragmentation of land

(1) The land classified as agricultural area according to section 4 of the Act or designated as agricultural area according to sub-rule (7) of rule 5 cannot be divided in such a way that the area is less than the following area:- (a) Five hundred square meters in Kathmandu Valley, (b) ) 675 square meters in Terai and Inner Madhesh, (c) 1000 square meters in areas other than the areas mentioned in clauses (a) and (b).
(2) According to Section 4 of the Act, land classified as residential area shall not be subdivided in such a way that the following areas and proportions differ:-
(a) having a minimum area of ​​less than one hundred and thirty square meters,
(b) In the case of a lot less than five hundred square meters, the length is more than four times the width.
(3) Notwithstanding anything written in sub-rule (1) or (2), the size or area of ​​any portion is inconsistent with another portion of the boundary. If it is found suitable to match the plot including the area, then the plot can be allotted for matching.
(4) According to sub-rule (3) when plot is divided and matched, it should be done in such a way that it is merged in the respective lot.
(5) (The relevant local level may determine the necessary criteria for allotment of land so as not to fall within the area mentioned in sub-rule (1) or (2).
(6) Notwithstanding anything written elsewhere in this rule, if it is deemed necessary to determine and apply different standards or bases in a certain area or place, the Government of Nepal may publish a notice in the Nepal Gazette and determine the standards or bases.
