Section 12
Sale and distribution of land
: (1) The land confiscated under this Act shall be sold and distributed by the commission subject to section 13 as follows –
(a) Before the commencement of this Act, if someone has acquired land in accordance with the rules and has earned income by enjoying that land, the person or family who earns by enjoying that land,
(b) Before the commencement of this Act, if one or more families or persons have acquired the same land, among such families or persons, the family or persons who have received income from the use of that land, but among such families or persons who previously received income from the use of land, A family or a person who is forcibly removed from a family or a person who earns before someone else earns later,
(c) If a person or a firm or an organization acquires land in accordance with the rules before the promulgation of this Act under the condition that it is imposed for the purpose of a certain program and plan, if it is given to another to earn without doing so according to the condition, to the family or person who earns such land himself,
(d) Except in the cases written in clauses (a), (b) and (c), if any person or family is residing on any land without being a land owner or tenant in the development area until the day before the promulgation of this Act, such land shall be transferred to such family or to the person.
(3) If any family or person of a particular land has received the land sale and distribution, but has not been in possession of the land, or if they have received the land in the previous agreement, Gauchar Bato, etc., after the promulgation of this Act, such grant will automatically be void.
(4) A person or a family who has acquired land in accordance with the Development Zone Rules and is enjoying the practice of enjoyment shall not be able to acquire land in sale and distribution under this section.
(a) Before the commencement of this Act, if someone has acquired land in accordance with the rules and has earned income by enjoying that land, the person or family who earns by enjoying that land,
(b) Before the commencement of this Act, if one or more families or persons have acquired the same land, among such families or persons, the family or persons who have received income from the use of that land, but among such families or persons who previously received income from the use of land, A family or a person who is forcibly removed from a family or a person who earns before someone else earns later,
(c) If a person or a firm or an organization acquires land in accordance with the rules before the promulgation of this Act under the condition that it is imposed for the purpose of a certain program and plan, if it is given to another to earn without doing so according to the condition, to the family or person who earns such land himself,
(d) Except in the cases written in clauses (a), (b) and (c), if any person or family is residing on any land without being a land owner or tenant in the development area until the day before the promulgation of this Act, such land shall be transferred to such family or to the person.
(3) If any family or person of a particular land has received the land sale and distribution, but has not been in possession of the land, or if they have received the land in the previous agreement, Gauchar Bato, etc., after the promulgation of this Act, such grant will automatically be void.
(4) A person or a family who has acquired land in accordance with the Development Zone Rules and is enjoying the practice of enjoyment shall not be able to acquire land in sale and distribution under this section.
