Rule 16
Management of Hazardous Substances
(1) The Ministry will list hazardous substances on the recommendation of the department.
(2) Any person or organization wishing to import, collect, store, process, sell, distribute, dispose or transport hazardous substances shall submit an application to the Bureau in the format as per Schedule-16.
(3) On receipt of any application according to sub-rule (2). If the department finds it appropriate to give permission to such a person or organization while conducting the necessary investigation in that regard, it shall issue a permit in the format as per Schedule-17, specifying the necessary conditions. (4) The term of the permit as per sub-rule (3) shall be five years. A person or an organization that has received a permit may apply to the department for renewal of such permit.
(5) In accordance with sub-rule (4), the application for renewal should be submitted at least thirty days before the expiry date.
(6) Upon receipt of an application as per sub-rule (5), the department may renew the permit for an additional two years if it deems it necessary to carry out necessary investigations in this regard.
(7) A person or an organization that imports, collects, stores, processes, sells, distributes, disposes or transports dangerous substances with permission in accordance with this rule shall prepare a statement in the format as per schedule-18 and submit it to the department within thirty days of the end of each financial year.
(8)/If it is found that a person or an organization granted a permit according to this rule does not comply with the conditions specified at the time of obtaining the permit or does not manage hazardous substances, the department shall order such person or organization to immediately comply with such conditions or manage such hazardous substances.
(9) The department shall send a written notice to the concerned body for taking action according to the law to the person or organization that does not comply with the order given in accordance with sub-rule (8).
