Section 37
The Debenture Trustee can inquire and demand details
: The Debenture Trustee may make necessary inquiries and obtain or demand details, information or information on the following matters before entering into an agreement with the company to act as a Debenture Trustee and if so requested, the concerned company shall provide the same:-
(a) Whether there is a provision in the articles of association or regulations of the company to raise debt or debentures and if there is such provision, whether the board of directors of the company has the right to decide to raise debentures in that way,
(b) Whether or not there is a provision to collect debentures through the debenture trustee according to the articles of association or regulations of the company. (c) whether the existing equity of the company is capable of covering the value of the debentures to be raised,
(d) Matters related to other creditors and liabilities of the company (e) Company's balance sheet and auditor's report,
(f) Other necessary matters as deemed fit by the Debenture Trustee.
