If any of the following acts are committed, it shall be considered as an offense of fraudulent appointment:-
(a) If he is appointed to another team or department other than the team or department in which he was employed without being relieved of duty through regular procedures from the team or department in which he is employed or without fulfilling the necessary conditions for the purpose of appointment,
(b) When a person is appointed to any part of the Nepali Army, if he is involved in getting such person appointed to any part of the Nepali Army, despite knowing or having reasonable cause to believe that he has committed an offense under this Act,
(c) If it is proved that the details of the lottery have been knowingly given in the application form for admission,
(d) If forged or fake certificates are submitted for other purposes of service including recruitment, promotion and training.
