: (1) Notwithstanding anything contained in section 25, if the communication of a person in connection with the investigation of the specified crime is not immediately recorded, in the following cases at the request of the investigating officer or if necessary, at least by the police officer of the rank of Additional Inspector General of Police himself in writing. may order the investigation officer or other police personnel in writing to record the communication of a person after finding cause:
(a) if there is a possibility of immediate death or immediate serious injury to the living,
(b) if the national security or interest of the country is affected, or
(c) Government, public or private structures or property are likely to be immediately destroyed or set on fire.
(2) When ordering the immediate recording of communications in accordance with sub-section (1), the investigation officer himself or under his direct guidance and supervision, at least a police officer of the rank of police inspector or the operator of such communication service, shall give the order in such a way that only such communication service can be recorded.
(3) When giving an order to record communication immediately in accordance with this section, to order the concerned officer to record the communication without any kind of hindrance, and to order the concerned communication service provider or the person who owns or operates the business or any other related person to provide the necessary assistance to such officer to intercept the information. will fall.
(4) The officer issuing the order in accordance with sub-section (1) shall submit the order to the authorized officer for approval within twelve hours of issuing the order.
(5) If the authorized officer disapproves the order as per sub-section (4), the authority and the communication service provider shall also be ordered to immediately stop the work related to the communication record and to destroy all the recorded communication on the same day as specified.
