Section 14
Punishment
: (1): A person who commits acts prohibited under Section 4 shall be punished as follows according to the amount of the crime:
(a) Imprisonment up to one month or fine up to two thousand rupees for a person who consumes ganja. However, if the person or institution who undertakes the treatment at the medical center for a month provides a document, the officer looking into the case may not punish such a person by submitting a report on the treatment from the said medical center within fifteen days.
(b) A person who cultivates up to twenty-five plants of marijuana shall be imprisoned for up to three months or fined up to three thousand rupees.
(c) A person who cultivates more than twenty five plants of marijuana shall be imprisoned for three years or fined from five thousand rupees to twenty five thousand rupees.
(d) The person who produces, prepares, buys, sells, distributes, exports or imports, transports and stores marijuana:
(1) Imprisonment up to three months or fine up to three thousand rupees if it is up to fifty grams.
(2) Imprisonment from one month to one year and fine from one thousand to five thousand rupees if it is between fifty grams and five hundred grams.
(3) Imprisonment from six months to two years and fine from two thousand rupees to ten thousand rupees in case of five hundred grams to two kilograms.
(4) Imprisonment for one year to three years and a fine of five thousand to twenty five thousand rupees if it is between two kilograms and ten kilograms.
(5) Imprisonment from two years to ten years and fine from fifteen thousand rupees to one lakh rupees regardless of the amount from ten kilograms to one lakh rupees.
(e) Imprisonment up to one year or fine up to 10,000 rupees for a person who consumes opium, coca or narcotic drugs made from them. However, if the person or organization who undertakes to undergo treatment at the medical center for three months submits a document and submits the information about the treatment at the medical center within fifteen days, the officer who hears the case may not punish such a person.
(f) To a person cultivating opium or coca :
(1) Up to twenty-five plants from one year to three yearsAnd a fine of five thousand rupees to twenty five thousand rupees.
(2) Imprisonment for three years to ten years and a fine of twenty five thousand rupees to two lakh rupees for any amount above twenty five plants.
(g) A person who engages in the consumption and cultivation of opium, coca or other narcotic drugs made from the same prohibited acts –
(1) Those who trade up to twenty-five grams shall be imprisoned for five years to ten years and fined from five thousand to twenty five thousand rupees.
(2) Those who trade between twenty-five grams and one hundred grams shall be imprisoned for ten years to fifteen years and fined from seventy-five thousand rupees to two hundred thousand rupees.
(3) Anyone who deals in any quantity above one hundred grams shall be punished with imprisonment from fifteen years to life and a fine of five lakh to twenty five hundred rupees.
(h) Any person who is addicted to natural or synthetic narcotics or psychotropic substances and their salts and other substances prescribed by the Government of Nepal from time to time shall be imprisoned for two months or fined up to two thousand rupees or both. However, if any person or organization that takes care of such an addict for three months of treatment at a medical center provides a document and submits the information that he has been treated at such a medical center within fifteen days, the officer looking into the case may not punish such a person.
(j) Persons who commit prohibited acts other than those mentioned in Clause (h) above shall be imprisoned for two years to ten years and fined from one lakh rupees to twenty lakh rupees. Explanation: For the purposes of this section, "amount of crime" means the nature, quantity, possession, purchase-sale, transportation-distribution or export-importation of narcotics, the gang or organization of the accused, the use of weapons or force by the accused and the involvement of minors in the criminal act. , the amount of crime to be determined on the basis of transactions made through institutions such as educational, social and cultural organizations, persons holding public office abusing their positions.Should fall.
