(1) If someone does mineral work without taking permission to do mineral work in accordance with this Act, the Government of Nepal shall stop such mineral work and confiscate the equipment, tools, tools and goods used in the mineral work and also the minerals mined in an unauthorized manner. Such a person may be fined up to one lakh rupees and may also be compensated for the loss of property caused by such act.
(2) The permit holder shall comply with Section 11A. If the instructions given as per section 13 are not complied with, the department may suspend mineral operations or cancel the permission to carry out mineral operations until such instructions or orders are complied with. In case of injury or damage to someone's life or property, a fine of up to one lakh rupees can be imposed and reasonable compensation based on the loss will also have to be paid by the authorized person.
(3) If the permit holder does not give the notice or report to the department according to section 20, the department may suspend the mineral work until such notice or report is given.
(4) If the permit holder does any work in violation of this Act and the rules made under this Act, the department may fine him up to one lakh rupees or cancel the permit granted to him for mining operations.
(5) Before taking action under sub-section (1), (2), (3) or (4), the department shall give reasonable opportunity to the concerned person to submit an explanation.
(6) If anyone obstructs or obstructs the mining operations of the department or the person who has the permit in accordance with this Act, he may be punished with imprisonment up to 6 months or a fine of up to ten thousand rupees, or both, by the order of the official appointed by the Government of Nepal by publishing a notice in the Nepal Gazette.
(7) A person who is not satisfied with the order of punishment made under sub-section (1), (2), (3), (4) or (6) may appeal to the High Court within thirty-five days.
