Section 6
Unable to register party

(1) Notwithstanding anything contained in section 5, a party shall not be registered in any of the following cases:-
(a) If the party does not fulfill the condition as per clause (4) of Article 269 of the Constitution,
(b) If the party's name, purpose, symbol, flag, statutes, regulations and work, action, clause (5) of Article 269, clause (2) of Article 270 and this Act are contrary to the Constitution,
(c) If it is seen that citizens of Nepal have been restricted, deprived or discriminated against on the basis of religion, caste, caste, sect, language or gender to obtain membership of the party,
(d) If the constitution of the party does not mention what should be mentioned in accordance with sub-section (2) of section 8,
(e) If the name or symbol of the party matches the name or symbol of the party registered with the Commission,
(f) If the name, purpose, symbol or flag of the party is of a nature to disturb or disintegrate the religious or communal unity of Nepal or if it is prejudicial to public morals,
(g) If the details or documents requested by the Commission are not provided in accordance with sub-section (3) of section 5 or if the signature of the officer or member cannot be authenticated.
(2) If it is not possible to register the party due to any reason under sub-section (1), the Commission may notify the concerned applicant to submit the corrected details for the registration of the party to the Commission within fifteen days after discovering the reason.
(3) If such information is received within the period as per sub-section (2) and if the commission is satisfied with it, the commission shall register the party in accordance with sub-section (4) of section 5 and give its certificate to the petitioner and if the party cannot be registered, it shall inform the petitioner of the reason.
