Rule 76
Daily Issue Payee List
(1) From among the cases included in the weekly pay list, a court shall be formed as prescribed by the Chief Justice and a daily case pay list shall be prepared and the relevant officer shall paste it on the notice board of the court and the relevant court and give a copy thereof to the concerned judge.
(2) If any case is pending before the bench, it will be submitted for consideration by the same bench on another day.
(3) If for any reason the bench as per sub-rule (2) cannot be constituted, such case which is under consideration may be constituted and assigned to another bench.
(4) If the Chief Justice deems it necessary, he may designate a particular day of the week to hear particular types of cases. If the day is fixed, the daily pay list of the case will be prepared accordingly.
(5) Notwithstanding anything contained elsewhere in these Rules, when a case is presented before the Bench, it shall be presented in the following order:-
(a) Settlement, settlement, return of appeal or application, amendment of statement, affidavit, judgment or order, case to be submitted to the bench due to difficulties arising in the procedure of the case, application to remove the opposition and be allowed to participate in the trial, remission of sentence Petition to receive, seeker, case for judgment, petition for permission to keep heirs, petition to receive leave from Tameli,
(b) Detainee Directing,
(c) Matters pending,
(d) A.V. 17 no. Petitions of detainees filed under,
(e) Application for interim order,
(f) Application regarding interim orders,
(g) Application for setting aside the interim order and the interim order,
(h) A.V. 17 no. Other petitions filed under,
(i) Application to get facility of court fee,
(j) applications to the Chief Registrar or the order of the Registrar,
(k) Application for reconsideration,
(l) Date of hearing by BenchDesignated issue,
(d) a case in which the foreign appellant or accused is detained or incarcerated,
(l) a case in which the appellant or the accused is imprisoned or imprisoned, except in clause (l); (n) Cases in which children are parties,
(i) Cases of older date exceeding seventy-five years,
(r) Cases involving persons with physical disabilities,
(d) Divorce, divorce, annulment, maintenance of relationship, partiality or domestic violence cases, whether women are plaintiffs, appellants or respondents; (d) Cases where a widow is a plaintiff or appellant,
(No) Writ Petition against the final and interim order passed by the High Court in connection with the execution of the judgment,
(p) Writ Petition against the interim order passed by the High Court in connection with the proceedings of the case,
(f) Writ petitions relating to arbitration,
(b) Cases in which interim orders have been issued,
(b) a case ordered to be tried by the Chief Justice or the Trial Bench, which the nature of the case requires to be disposed of expeditiously,
(i) Writ Petition
(y) Part Issue,
(r) a case in which a foreign national is a party to or against,
(l) According to old order of date of registration of cases.
(6) Even if the cases from clauses (a) to (l) of sub-rule (5) are not included in the weekly pay list, they will be heard in the daily pay list.
(7) Notwithstanding anything written in clause (l) of sub-rule (5), a list of payments may be prepared in such a way that the cases for which the date of payment is fixed are to be submitted together as per sub-rule (2) of rule 74.
(8) If more than one pay list is assigned to the same bench on any day, the case of the previous order mentioned in sub-rule (5) which is first in the pay list shall be heard first.
(9) According to Clause (l) of sub-rule (5), the hearing date of the case shall be heard on the appointed day.If not, it will be submitted in priority according to clause (B).
(10) According to sub-rule (8), after all the cases of one payee list have been heard, the other payee list cases will be heard in the same order.
(11) If the work of reviewing the cases on the daily payee list is completed before one o'clock in the day by a bench, the appeals that have not been received, the petitions that have passed the date, the cases that are not on the party date and the lawyers have not been appointed or the review petitions can be removed from the supplemental payee list of the same day.
