(1) Subject to sub-section (2), any person may give and take mortgage rights in accordance with this Act. In this way, mortgage rights can be given and taken in such a way that mortgage rights of more than one person are created on a mortgaged property. (3) The right of mortgage shall not be considered invalid just because the person giving the mortgage has the right to use, enjoy, sell, exchange, mix or transfer the right in any other manner.
