(1) If it is deemed necessary to prohibit or control the export or import of any item for the achievement of the following objectives, the Government of Nepal may, by a notified order, specify conditions or a certain period for the export or import of such item or may prohibit or impose total or quantitative restrictions –
(a) To protect national security interests,
(b) to maintain public decency, decency or morality,
(c) to regulate the trade in gold, silver or other similar metals or precious stones,
(d) To protect human, animal, bird or plant life from acts injurious to health,
(e) to make proper arrangements regarding the importation of goods produced by the labor of inmates or prisoners of prisons,
(f) to preserve national heritage of artistic, historical or archaeological importance,
(g) To make appropriate arrangements for the conservation of natural resources that may disappear (including domestic production or use),
(h) To ensure the availability of domestic raw materials required for a competitive national manufacturing industry,
(i) To make proper arrangements for the procurement and distribution of goods that are in short supply at the local level
(j) To protect the country's external financial position and balance of payments by removing or preventing serious deterioration in foreign exchange reserves or by increasing foreign exchange reserves which are in very low condition,
(k) to prevent serious shortages of essential foodstuffs or other similar products,
(l) To maintain standards of classification, grading or marketing of consumables in international trade, (d) To enjoy exemptions or concessions provided in foreign trade for least developed countries,
(d) Unexpectedly large quantities of imported goods may cause serious harm to the national industry producing goods of the same nature.To protect against adverse effects,
(n) To protect intellectual property such as patents, trademarks, copyrights, industrial designs, geographical indications (geographical indications), protection of confidential information,
(p) To promote or protect new skill or technological industries which will increase the competitiveness of the country,
(r) to prevent unfair or unauthorized trade practices or to control unfair competition,
(d) To implement the Charter of the United Nations and multilateral international conventions or bilateral agreements to which Nepal is a party and to fulfill the obligations created therefrom.
(2) If it is deemed that it is not necessary to maintain the ban imposed on the export or import of any item as per sub-section (1), the Government of Nepal may modify, change or remove such ban at any time by an informed order stating the basis and reason thereof.
