(1) The exporter must declare to the customs officer that he will pay the price declared in the said notification in the foreign exchange accepted by the bank within the specified period.
(2) Before receiving the payment for the exported goods, if there is a situation where the price is lower or higher than the price declared in the notification letter, the exporter has to apply to the bank with proof of the same, and if the said thing is confirmed, the bank can give permission to receive such lower or higher payment. p>
(3) If the exporter does not receive payment for the price of the exported goods within the period specified under sub-section (1), he shall be deemed to have violated this Act.
(4) Notwithstanding anything written in sub-section (3), if the exporter submits an application to the bank along with evidence for not being able to receive payment for the value of the exported goods within the period specified under sub-section (1), and if the bank is convinced of the same, the bank may extend the period to the concerned exporter. Can order:-
(a) To bring payment for the goods if they have been sold,
(b) If the goods cannot be sold, to sell them and bring payment or to bring such goods back to Nepal. However, if the exporter submits an application to the bank along with proof of reasons for not being able to pay for the exported goods due to circumstances beyond his control, the bank may, after necessary investigation, return such goods or give a discount without having to bring partial or full payment.
(5) If the bank wants to prove that the price declared in the notification is paid in the specified manner within the specified period, it may ask the exporter to submit the related contract and other evidence with the foreign buyer.
(6) In order to ensure that the full price of the exported goods is received, the bank shall pay all or any particular type of goods exported or all or any particular exporter's goods.The bond may issue an order as follows:-
(a) Payment for exported goods should be received only through receipt or other means specified by the bank, except in cases specified otherwise by the Government of Nepal,
(b) According to sub-section (1), the said declaration should be submitted to the authority or institution designated by the bank to prove that the price declared in the declaration is the actual value of the export,
(7) Notwithstanding anything written elsewhere in this section, the process of extracting knowledge and information technology and receiving loan payment shall be as prescribed by the Bank by publishing and broadcasting public information.
