Section 16
Transparency should be maintained while making decisions

(1) An officer who can make a decision in accordance with this Act or any other prevailing law shall make a decision in a transparent manner when deciding on a matter. Explanation: For the purpose of this Act, "transparency" means a process to be decided on the basis of certain standards and the word shall not adversely affect the matter which is to be kept secret according to the prevailing law. .
(2) In order to maintain transparency in accordance with sub-section (1), the decision-making officer may take into account the opinion and consultation of his subordinates on matters to be decided.
(3) If the action of the matter to be decided is started from one level and the decision is to be made from another level, the officials involved in each level must present their clear opinion on the matter to the decision-making authority.
(4) According to sub-section (3), if any question has arisen in the opinion submitted by each level official who is involved in the decision-making process, the decision-making officer shall also address such question when making a decision.
(5) When making a decision, a legal or technical question must also be considered and the decision-making authority may seek the opinion of a legal expert or technician on such matters if he deems it appropriate.
(6) If an opinion is taken according to sub-section (5), a decision can be made based on such opinion and if it is seen that such opinion should not be accepted, the reason for that should be decided.
(7) Other arrangements related to transparency shall be as prescribed.
