Rule 65
SPECIAL EVALUATION OF BID FOR CONSTRUCTION WORK

(1) While evaluating the bids for the construction work, the evaluation committee shall evaluate the following things in addition to the things mentioned in rules 62, 63 and 64:-
(a) Whether or not the work plan, performance schedule and operating time of the construction work are as mentioned in the tender documents,
(b) whether the per unit rate mentioned by the bidder for the item enclosed in the Bill of Quantity is reliable or not,
(c) Whether or not the balance sheet is unbalanced due to:-
(1) because the tenderer has quoted an abnormally high rate for the item of work to be done at the initial stage of the procurement contract, or
(2) Because the bidder has quoted an abnormally high rate for an item in the bill of quantities which he believes to be a low estimate.
(d) Clause
of sub-section (2) of section 13 of the Act submitted by the bidder Whether or not he has the technical ability to complete the construction work in accordance with (E) details.
(2) In the case of Clause (c) of sub-rule (1) or in the case where the tenderer is unable to complete the work satisfactorily, the bidder mentions a low acceptance rate, or misunderstands the area or technical specification of the construction work, or mentions an abnormally low acceptance rate at the initial stage. The assessment committee will have to check whether or not more rates have been mentioned for the construction work (front loading). In the case where the low bid score is mentioned or as per clause (c) of sub-rule (1), the evaluation committee shall request an explanation including rate analysis from such bidder.
(3) If the explanation requested by the evaluation committee according to sub-rule (2) is satisfactory, it may recommend to the public body to accept the bid by taking an additional performance bond equal to eight percent of the bid score from such bidder and if such explanation is not satisfactory, it may recommend to the public body to reject such bid.
(4) The additional performance bond taken in accordance with sub-rule (3) has been paid in the final billand will have to be returned.
(4a) When the evaluation committee evaluates the bids in accordance with Section 25 of the Act, the financial and technical capacity of the bidder in use in any public body or project as mentioned in the documents related to the bid shall not be counted for additional work to the extent that such body or project requires the financial and technical capacity of such bidder.
(4B) For the purpose of sub-rule (4A), the financial and technical capacity of the bidder in use in any public body or project, to the extent necessary for such public body or project, the bidder shall take the details from that body or project and submit the documents related to the bid.
(4c) The fact that the bidder can only accept bids up to seven times the average annual turnover (turnover) amount of the annual turnover amount of the construction works of any three financial years with the maximum turnover he has done, should be taken as the basis for the qualification and evaluation of the bidder. In this way, when calculating the annual turnover of three financial years, it should be calculated from within the immediately preceding ten financial years.
(4d) According to sub-rule (4c), when calculating the amount which will be seven times of the annual transaction amount, it should be determined only by subtracting the annual liability amount for the current contract of the bidder.
(4e) For the purpose of this rule, the bidder shall submit a self-declaration regarding the financial and technical capacity and submit the details along with the documents related to the bid. If the information submitted in this way is found to be false, the bid submitted by him will be removed from the evaluation process and action will be taken according to the prevailing law. . %(4e1) According to sub-rule (4e), the bidder shall declare his financial capacity and submit the documents and details when he submits the liquid assets, credit facilities and other financial resources that can arrange the cash flow related to his financial capacity.
(4f) For the purpose of this rule, the bidder's assets should be greater than net liabilities in the balance sheet of the last financial year.
(4g) Sub-rules (4A), (4B), (4C), (4D), 04E), (4N1) and (4F) notwithstanding anything written in the case of tenders under evaluation process before the commencement of this rule shall be in accordance with the provisions existing before the commencement of this rule.
