Section 20
suspend
:
(1) According to section 19, the officer authorized to order the punishment of the armed police who has been subjected to departmental action may suspend him for a specified period.
(2) Before suspension in accordance with sub-section (1), such armed police shall be disarmed by the officer who ordered the punishment.
(3) The armed police shall be deemed to have been automatically suspended in the following cases :—
(a) If the armed police accused of the crime under section 27 is arrested, from the date of arrest and if not arrested, from the date of decision to file the case,
(b) In case of arrest and detention on any criminal charge, throughout the period of such detention.
(4) If an armed police is suspended in connection with government work or as a result of an action taken by the Government of Nepal, during the period of such suspension, he/she shall receive only half of the salary earned. However, if the allegations are not proven and he is cleared, if he received half of his salary during the period of suspension, then he will receive full salary (including salary increase if there is a salary increase). If found guilty, he will not get the remaining salary from the date of suspension.
(5) If an armed policeman is suspended for any reason other than the reason mentioned in sub-section (4), he shall not get the salary for the period of such suspension.
