Rule 42
Procedure for giving tender ballot
(1) If a voter wants to claim that someone else has taken the ballot paper or voted on his behalf, but he is the real voter, he can make the claim before the polling officer by attaching a certificate that he has been elected as a member of the Federal Parliament or the Provincial Assembly. (2) In the case of a claim made according to sub-rule (1), the polling officer has to ascertain whether he is a genuine voter as claimed by the claimant or not. If the claimant presents a certificate that he has been elected as a member of the federal parliament or a member of the provincial assembly, the polling officer shall take a copy of the same. (4) After making a decision according to sub-rule (3), the polling officer shall prepare the envelope of the tender ballot and make the signature of the claimant on the envelope, and write "tender ballot" in the empty space to the left of the place where the polling officer is correcting the ballot, and allow the voter who claims the ballot to indicate his vote. 5) In the ballot paper given as per sub-rule (4), the claimant voter shall mark his vote as per sub-rule (1) of rule 31 and give the ballot paper to the polling officer. The polling officer shall keep such an envelope in his charge. (7) The polling officer shall keep a separate record of the details of the claimant, the details of the evidence of the claimant and the decision.
