Rule 80
Pension
(1) The following military personnel who join the Nepali Army before 28th Baisakh of the year 2060 will receive pension from the date of retirement after serving in the army for the following period or more:-
(a) Assistant Soldier and above up to Maharathi twenty years
(b) Jamdar, Subedar and Chief Subedar for seventeen years
(c) Followers and above up to sixteen years
(2) The following military personnel who join the Nepali Army on and after 28th Baisakh of the year 2060 will receive pension if they take voluntary retirement from the service after serving in the army for the following period or more with the approval of the concerned head of department:-
(a) Assistant Soldiers and above up to Maharathi -twenty years
(b) Subedar and Chief Subedar “nineteen years
(c) Jamdar -Akhar year
(d) Pyuth, Amaldar and Hudda - Sessional Year
(e) Followers and soldiers sixteen years
(2A) Notwithstanding anything written in sub-rule (2), a military person who takes voluntary leave before completing twenty years of service - from the date of joining the Nepalese Army after completing twenty years of service - will receive the amount of pension only.
(3) The calculation of the pension to be given according to this rule shall be as follows:-
(a) In the case of Assistant Soldiers and above up to Maharathi, – Years of service × Last Pay
(b) Followers and above up to Chief Subedar and in the case of honorary co-seniors or honorary sub-seniors,–
(3A) When calculating the pension of a military person as per sub-rule (2A), the years of service and the last salary shall be calculated based on the years of service at the time of obtaining voluntary leave and the salary of the last month of leave while in service.
(4) Notwithstanding anything contained in sub-rule (3), the minimum amount of pension shall not be less than half of the first point of the pay scale of a military person of the same rank and the maximum amount shall not be more than the first point of the pay scale of a military person of the same rank.
(5) In case of re-appointment in any service of the Nepali Army after the person retired from any position of the Nepali Army with or without receiving gratuity.By adding the previous service period to the subsequent service period, the period for receiving pension will be reached. (6) If a military person from ordinary service comes to serve in the garrison group, he will get double pension including his previous service period.
(7) Notwithstanding anything written elsewhere in this regulation, if a military person dies while in service, if five years are added to his service period, if the period of pension is reached, his family will be allowed to choose whichever pension or gratuity they want to receive, with a maximum extension of five years. br> (8) After the age of the following military personnel who are receiving pension is sixty years, the pension will be increased as follows:-
(a) Rank or below – thirty percent.
(b) Jamdar – ten percent.
(c) Subedar – five percent.
(9) Ten percent will be added to the amount of pension received by a military person who is receiving pension of Jamdar or above, after reaching the age of seventy-five years, and ten percent amount will be added to the pension received by such person after reaching the age of eighty-five years. (10) The facilities as per sub-rules (8) and (9) will also be availed by those enjoying family pension.
(11) If a military person retires due to service period and does not reach the period for receiving pension, if two years are added to his service period, then if the period for receiving pension is reached, the pension can be granted by adding the service period to a maximum of two years.
(12) Regardless of what is written elsewhere in this rule, a person who has acquired the citizenship of another country with a permanent residence permit will not receive the pension according to this rule.
