Rule 44
Can apply
(1) A military person who is not satisfied with the promotion recommendation decision of the promotion committee can submit a petition to the secretariat with a clear and objective basis that he should be included in the promotion within seven days from the date of the promotion decision.
(2) After receiving the application as per sub-rule (1), the Secretariat shall submit the said application with its opinion to the following committee within seven days:-
(a) In the case of the petitioner who is to be promoted from the rank of Assistant Soldier to above,-
(a) Barishthatam Rathi – Chairman
(b) Candidates who are not in the promotion committee appointed by the Commander-in-Chief - Member
(e) Prad Viwak Chief – Member
(b) In the case of the petitioner who is to be promoted in rank,-
(a) Executive – Chairman
(b) Representative of Directorate of Military Organization – Member
(e) Authorized Representative of Prad Vivak – Member
(c) In the case of the petitioner who should be promoted to the rank of Puth, Amaldar, Hudda,-
(a) The president of the area where the concerned unit is located or the senior officer designated by him - chairman
(b) Officers appointed by the concerned Governor – Member
(e) Prad officer working in the concerned branch – Member
(3) If the committee under sub-rule (2) finds it necessary to make a recommendation for the promotion while making necessary selections on the application submitted according to sub-rule (1), it shall be sent in writing to the relevant promotion committee. If it is written in this way, the promotion committee will have to recommend again so that the seniority of the applicant is maintained.
(4) The committee should be able to make a decision on the application made according to this rule within seven days.
(5) If an application is received within the deadline specified by the decision of the promotion committee, only after the decision of the application, the promotion appointment process should be carried forward according to the recommendation of the promotion committee.
(6) In relation to promotion to the post of military officer, the Department of the Military Secretary, in relation to the promotion to the post of rank and file, and in relation to the promotion of other soldiers, the relevant department shall act as the secretariat of the complaint hearing committee.
