Section 4
Prohibited Acts
: No person shall do the following acts:
(a) to cultivate, produce, prepare, purchase, sell, distribute, export or import, transport, store or consume marijuana,
(b) to cultivate opium or coca or to produce opium or coca leaves or other drugs,
(c) to manufacture or prepare drugs,
(d) to sell and distribute narcotic drugs,
(e) to export or import narcotic drugs, and
(f) procuring, storing, possessing or distributing narcotic drugs, and
(g) Consuming narcotic drugs other than marijuana, but-
(1) The Government of Nepal may make regulations regarding the production of hashish for a specified period of time from the wild hemp plants that grow naturally in the western mountainous region of Nepal, the collection, storage and purchase and sale of such hashish and accordingly, after obtaining a permit Any person shall not be deemed to have committed an offense under this section.
(1a) Among the drugs as defined in the Single Convention on Narcotic Drugs, 1961, chemical substances used to prepare narcotic drugs may be imported-exported, transported-distributed, stockpiled, sold-distributed and used only with the permission of the Chief Drug Control Officer.
(2) The manner of the permit granted in accordance with the restrictive clause (1), the format and conditions of such permit, the authority granting the permit, the duties applicable thereto, the work to be performed pursuant to the permit, and other controls and arrangements shall be as prescribed above. Explanation: For the purposes of clauses (b), (c), (d), (e) and (f) of this section, the term "applicable drug" shall not refer to marijuana.
