(1) If a civil case is to be filed against the Government of Nepal, the provincial government or the local level, the interested person shall notify the office or the head of such office against whom the case is to be filed.
(2) If a notice is received according to sub-section (1), the concerned office or the head of that office shall consult or take the advice of any other office. (3) If there is any reason not to file a case when investigating the matter related to the information received according to sub-section (1), the relevant office or the head of the office shall give the information to the relevant person within thirty days from the date of receipt of such information with the clear reason.
(4) Within the period under sub-section (3), the relevant office or the head of that office shall not provide any information on the matter, even if the information is not required to be prosecuted, if the reason for this is unreasonable, the relevant person may file an annulment within thirty-five days from the date of receipt of such information.
