(1) If any person or organization wants to open lottery, they can give permission if they submit a written application with complete details of the lottery they want to open to the Government of Nepal and if the Nepal Government deems it appropriate.
(2) According to subsection (1), a person or an organization that has received permission to open a lottery may also conduct the sale and distribution of the lottery subject to the following restrictions:-
(a) When opening a lottery in support of any charity or public interest work, only the organization can open it and when such lottery is opened, 60 percent of the total amount received from the sale of the lottery will be distributed. After this, the remaining amount can be used by the related organization for charitable public interest and lottery operations.
(b) Prizes of other lotteries will not be in cash, except for the ones opened for charitable or public welfare work, and when the lottery is opened, 75 percent of the total amount received from the sale of the lotteries will be distributed in the form of prizes. The remaining amount after this can be taken by the person or organization operating the lottery as a profit and for the work related to the operation of the lottery.
(c) All lottery icons must have the following items opened: 1. Lottery value, 2. Details of the award, 3. Lottery opening place, 4. The name of the organization that distributes and operates lottery sales, 5. Lottery serial number, 6. Lottery opening and closing date, and 7. The date of receipt of permission to open the lottery from the Government of Nepal or the authorized authority.
(d) If permission is granted to open or operate in a place like a public exhibition place or a club or society, to distribute and operate the sale of lottery tickets elsewhere than in such a place. Not found.
(e) The value of each lot should be equal.
(f) Lottery cannot be sold without payment of the full price of the lottery.
(g) Lottery once sold shall not be returned.
(h) The procedure prescribed in the rules made under this Act shall be followed.
(3) In the case of determining the maximum total capital of the lottery and determining the price of each lottery, the Government of Nepal may issue an order by publishing a notice in the Nepal Gazette.
