(1) The jurisdiction of the Tribunal shall be exercised by the three members collectively and the opinion of the majority shall be deemed to be the decision of the Tribunal.
(2) Notwithstanding anything contained in sub-section (1), the law member and If one more member is present, the case can be processed and closed. Apart from the law member, in the presence of two members other than deciding the case or giving a final order, other actions can be taken. In the absence of other members, the law member shall not be hindered from taking action other than deciding the case or giving a final order.
(3) According to sub-section (2) in the presence of two members, in the case of proceeding or settling the case, if there is no unanimity between the two members, the presiding officer shall preside over the proceedings. It shall be done in accordance with the opinion of the member who is acting and in the case of judgment or final order, the opinion submitted to the absent member and supported by him shall be considered as the opinion of the tribunal. If there is a difference of opinion between the three members of the case or if there is no unanimity when the case is closed in the presence of two members according to sub-section (3), if there are three opinions when the case is presented before the absent member, then the applicant must be presented to the High Court and the decision made by the division bench of that court will be final. /p>
